Single Vehicle Crash Seriously Injures Passenger

In the early hours of the morning, Colorado Springs Police responded to a single vehicle accident on North Academy Boulevard just south of E. Bijou Street and discovered that the car had veered off the right side of the road and struck an electric tower.

The passenger of the car suffered serious injuries and was transported to a local hospital by ambulance.  The driver was detained for suspected DUI.  The intersection was closed while the Major Accident Unit of CSPD investigated the scene of the crash. 

When single vehicle crashes like this happen, injury victims sometimes assume that only the insurance of the at fault driver is implicated.  To the contrary, multiple policies of insurance may cover the injury claim of the passenger in this case.  The obvious starting point is the insurance of the at-fault driver, but if he was driving a vehicle owned by someone else, that liability policy would actually be primary over the at-fault driver’s own liability policy (meaning both would pay, but the owner of the vehicle’s insurance would pay first).  If the passenger had his own automobile policy which carried Uninsured/Underinsured Motorist coverage, that policy might well afford benefits to cover his injury claim.  Additionally, if the passenger lived with someone related to him by blood or marriage who also had a policy with Uninsured/Underinsured Motorist coverage, that policy might afford benefits to cover his claim as well.
